EB-5 Overview
To encourage foreign investment in the U.S. economy, Congress created the fifth employment-based preference (EB-5) pilot program in 1992 named The EB-5 Regional Center Investment Program. By so doing, Congress permitted the U.S. immigration agency (USCIS) to designate qualified applicants as Regional Centers. A Regional Center is a private enterprise or corporation with investment parameters regulated by the USCIS. Foreign investors seeking to invest in a business that will benefit the U.S. economy and create or save at least 10 full-time jobs will invest $900,000 USD in rural or high unemployment areas known as a Targeted Employment Area or TEA.
The EB-5 Regional Center Investment Program does not require that the foreign investor’s investment Project itself directly employ 10 U.S. workers. Instead, it is enough if 10 or more jobs will be created directly, indirectly, or inferred as a result of the investment through an economic report.
Before an investor can participate in a Regional Center EB-5 investment program, each investor must independently petition USCIS for an EB-5 visa. USCIS solely determines whether the investor qualifies for the EB-5 visa. USCIS’ diligence includes a detailed review of the sources of the investor’s funds, family history, and other representations of the head of household and his immediate family member under the age of 21.

Investor Process
Contact South Texas EB-5 Regional Center to fill out an Investor
Suitability Questionnaire.
Investor reviews available business projects and selects the best
project investment.
The PPM, Subscription, and Escrow are signed and $900,000 plus the Administration Fee are paid.
An attorney prepares and submits the immigration form I-526 to USCIS.
USCIS reviews the application (form I-526) and it is either accepted or denied.
If the form I-526 is denied, the legal documents and Escrow monies are returned. If the application is accepted, the Escrow monies are released to the project investment.
Immigration attorney submits visa application to United States Consulate.
If the application is denied, the attorney may appeal. If the application is accepted, the investor receives a “conditional” Green Card for his family.
In two years, the immigration attorney submits the immigration form I-829 for removal of conditions.

H1B Path to EB5 in USA starting at $500,000
The biggest hurdle for H1B holders in USA to apply for the EB5 green card is the amount required to invest which has now increased to $900,000. Most of the H1B holders already had some difficulties investing the old amount of $500,000 so the new amount of $900,000 is proving even more difficult. Look into our new product, “H1B Path” we will introduce in March that starts the EB5 green card process at $500,000 and can allow the filing of the Petition to be submitted, setting the Priority Date as early as month 12 or no later than month 24 depending on your financial position.
One of the most important events in the EB5 world is to secure the Priority Date as early as possible since the line for visas will likely not get shorter any time soon given the demand in green cards. As a result of the high demand, the USCIS website is showing the processing time for the I-526 is taking between 32 to 49 months or an average of 40.5 months.

F1 Path to EB5 in USA starting with $100,000
International students under the F-1visa may need to consider other options to remain in the USA after graduation as the EB-5 green card could be a more viable option in comparison to the H-1B visa. For those international students who have the monetary resources on their own or from their parents, it may be time to have the discussion and do some early planning on how to stay and work in the USA after graduation. In years back with the EB-5 Program, a permanent green card could have been reasonably attained within 5 years but now you are among the lucky ones if you can get one within 7 to 8 years and it depends on the country you were born.
Some international students and their parents had difficulties coming up with ready cash for the old amount of $500,000 before the deadline that almost doubled and increased the amount to now $900,000 as more time was needed to come up with the amount in cash ready to invest. This may be due to the general premise that most families who send their children to study in USA have their wealth tied up in their assets of family businesses and real estate. If they were given an 18-month payment plan to come up with the investment then it may provide some welcome flexibility and still allow the EB5 process to start. Look into our new product,“F1 Path” we will introduce in March which starts the EB5 green card process with an amount as low as $100,000 that can still allow the Petition to be filed, setting the Priority Date as early as the same month the first payment is made, with 18 months to complete the EB-5 investment.
